Postal Ban on Shipping Vapes
The amended PACT Act statute bans the U.S. Postal Service (USPS) from mailing vapes and other smokeless tobacco products. This amendment to the PACT Act is a coordinated partnership between ATF and USPS, and includes the Food and Drug Administrations’ Tobacco 21 law that prohibits the selling of all tobacco products to people under the age of 21 years old. The final rule was published in the Federal Register on 10/21/2021 as 39 CFR Parts 111 and 121, at p 58398.

The PACT Act Amendment prohibits sellers from using the U.S. Post Office to ship e-cigarettes, vapes, flavored and smokeless tobacco products. The PACT Act applies to all shipments in interstate commerce (15 U.S.C. § 376) as well as to all delivery sales.

Along with the USPS, Fedex, and UPS no longer accepts packages containing vapes.

Mandatory Adult Signature Service

In compliance with federal regulations, all orders for vape-related products shipped via mail will necessitate Adult Signature Confirmation (21+) upon delivery. Recipients must present a valid government-issued photo ID to the delivery personnel for age verification in order to receive the package.

Utilizing the Adult Signature service incurs an extra fee of $7, which will be displayed in the checkout process. If it is more convenient for you, we can deliver your vape products to a business address; however, we regret to inform you that we are unable to ship to PO Boxes.

State Regulations

Due to recent state regulations banning vape and flavored vape online sales, we are only available in Texas.

Orders containing prohibited items will be eliminated and canceled from the order, with the possibility of the entire order being canceled and refunded. The remainder of the package will continue to be processed as usual.

Undelivered and/or Lost Packages:

Stay Puffed LLC disclaims responsibility for lost or undelivered packages, and any concerns related to unreceived packages must be addressed by the customer directly with the third-party carrier engaged for shipping. Stay Puffed LLC is committed to addressing and resolving such issues promptly, and any discrepancies in shipping must be reported within 48 hours of the latest tracking update.

In instances where packages are marked as Delivered by third-party shipping carriers, Stay Puffed LLC cannot assume responsibility. Customers are required to resolve this directly with the third-party shipping company to resolve any issues arising from such shipments marked as delivered.

It is important to note that inaccurate or incomplete address submissions by the user may result in delays, returns, and other complications affecting the successful delivery of the order. Stay Puffed LLC bears no responsibility for any costs associated with inaccuracies or incorrect address submissions made by the user.
